“What is the responsibility for disclosing confidential information in the absence of a commercial secret regime?” - Article for The Jurist magazine.

The October issue of Jurist magazine contains an article by Anastasia Morgun on the topic “What is the responsibility for disclosing confidential information in the absence of a commercial secret regime?”.

The article provides the relationship between the concepts of "confidential information" and "commercial secret", describes the types of statutory liability, and analyzes the existence of grounds for bringing a counterparty to it for disclosing confidential information if liability was provided for in a civil law contract, but the regime no trade secret has been established in the company. The author proposes specific wordings recommended for inclusion in the contract with the counterparty; highlights the changes that can be expected against the background of the emergence of new types of undisclosed information.
